Terms of Service

1. Agreement
By downloading, installing, or using Dictto ("the Software"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Software.
2. License
Dictto grants you a personal, non-exclusive, non-transferable license to use the Software on devices you own, subject to the terms of your purchase (trial, free tier, or paid license).
3. Restrictions
You may not:
- Reverse engineer, decompile, or modify the Software
- Redistribute, resell, or sublicense the Software
- Use the Software for any illegal purpose
- Remove or alter any proprietary notices
4. Intellectual Property
Dictto and its original content, features, and functionality are owned by Shrimpi & Squiddy Labs and are protected by international copyright and trademark laws.
5. Third-Party Services
Dictto uses WhisperKit for speech recognition (running locally) and Paddle for payment processing. Your use of these services is subject to their respective terms.
6. Purchases and Payments
All purchases are processed by Paddle.com Market Ltd as our Merchant of Record. By making a purchase, you also agree to Paddle's Terms of Service.
7. Speech Recognition Accuracy
Dictto uses AI-powered speech recognition (OpenAI Whisper via WhisperKit). You acknowledge that:
- Speech recognition is not 100% accurate and may contain errors, omissions, or misinterpretations
- AI models may occasionally produce unexpected or incorrect output ("hallucinations")
- Accuracy varies based on audio quality, accent, background noise, and other factors
- You are solely responsible for reviewing and verifying all transcribed text before use
8. Not for Critical Use
Dictto is a productivity tool and is NOT designed or intended for use in situations where errors could cause harm. You agree NOT to rely on Dictto for:
- Medical records, prescriptions, or healthcare documentation without professional review
- Legal documents, contracts, or court transcriptions without professional verification
- Financial transactions or records without verification
- Any situation where transcription errors could result in injury, death, or significant loss
If you choose to use Dictto in professional contexts, you assume full responsibility for verifying accuracy.
9. Data Loss
You acknowledge that audio recordings and transcriptions may be lost due to software errors, system failures, or other issues. You are responsible for maintaining your own backups. We are not liable for any data loss.
10. Disclaimer of Warranties
THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SOFTWARE WILL BE ERROR-FREE, UNINTERRUPTED, OR FREE OF HARMFUL COMPONENTS.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL DICTTO, ITS CREATOR, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING FROM:
- Your use or inability to use the Software
- Errors, mistakes, or inaccuracies in transcriptions
- Any decisions or actions taken based on transcribed content
- Loss of audio recordings or transcribed text
OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SOFTWARE.
12. Indemnification
You agree to indemnify and hold harmless Dictto and its creator from any claims, damages, or expenses arising from your use of the Software or violation of these terms.
13. Governing Law
These terms shall be governed by the laws of the State of California, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of California.
14. Changes to Terms
We reserve the right to modify these terms at any time. Continued use of the Software after changes constitutes acceptance of the new terms.
